Learning Terms and Conditions

Introduction
Welcome to Dragonfly Learning. These terms and conditions (the “Terms”) apply to your use of the learning site at www.dragonflylearning.co.uk and to all free and paid continuing professional development (CPD) and other learning content you access through it.
My CPD is provided on a self-paced, on-demand basis. When you register for or purchase a session, you are given access to recorded content and any accompanying materials to work through in your own time.
These Terms do not apply to therapy services, wellness walks, in-person workshops, or purchases from my online shop, which are governed by separate terms provided when you book or buy those services.
Please read these Terms carefully. By registering for free content, or by placing an order for paid content, you confirm that you have read, understood, and agree to be bound by these Terms.

2. Who Can Register
To register for or purchase CPD, you must be at least 18 years of age and legally able to enter into a binding contract under English law. By registering or placing an order, you confirm that you meet these requirements.
My CPD is designed for two audiences: professionals (such as therapists, counsellors, healthcare staff, and educators) seeking continuing professional development, and interested members of the public who wish to learn more about a topic. Where content is aimed primarily at one of these audiences, this is indicated in the description.
3. Free Content
Some content on the learning site is provided free of charge. To access it, you may be asked to register with your name and email address. Free content is provided for your personal learning and on the same terms of use as paid content (see section 11). I may add, change, or remove free content at any time without notice.
4. How a Contract is Formed (Paid Content)
When you place an order for paid content, you are making an offer to buy access to that content. I will confirm receipt of your order, and a binding contract is formed when I confirm that access to your content has been made available.
I reserve the right to refuse or cancel any order, including if there has been an obvious pricing or description error or if I suspect the order is fraudulent. If I cannot accept your order, I will let you know as soon as possible and refund any payment already taken.
5. Price and Payment
All prices are shown in pounds sterling (GBP) and are inclusive of UK VAT where applicable. The price you pay is the price displayed at the point of checkout.
If content has been incorrectly priced due to a system error, I will contact you before processing your order to confirm whether you wish to proceed at the correct price or cancel. I am not obliged to supply content at an incorrect price.
Payment methods: I accept payment by debit or credit card through Stripe. Payment is taken at the point of order. I do not see, store, or have access to your full card or bank details. Stripe acts as an independent data controller for your payment information and has its own privacy notice.
6. Access to Content
On-demand CPD is delivered online through the learning site or course platform. Once your order is confirmed, you will be able to access your content through your account or via a secure link.
Unless stated otherwise in the content description, access is granted for your personal use for a period of 12 months from the date of purchase. I aim to keep content continuously available, but I do not guarantee uninterrupted access and may carry out maintenance or updates from time to time.
To access the content you will need a device capable of playing online video and opening PDF files, and a stable internet connection. I am not responsible for issues arising from incompatible devices, software, or connectivity at your end.
Where downloadable materials (such as slides, handouts, or workbooks) accompany a session, these are provided for your personal use only and remain subject to section 11.
7. CPD Certificates
A CPD certificate is available for paid CPD sessions. Where a certificate is offered, this is stated in the session description, together with the indicative CPD hours.
Once you have completed a paid session by watching it, your certificate is issued automatically, recording your name, the session title, the date of completion and the indicative CPD hours. You are responsible for ensuring the details associated with your account are accurate, as they appear on the certificate.
CPD hours are indicative and provided in good faith. It is your responsibility to confirm whether a given session meets the CPD requirements of your professional body or employer. Free content is provided for learning and does not normally carry a certificate unless stated.
8. Your Right to Cancel
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you are a consumer based in the UK you normally have a 14-day right to cancel a purchase of digital content, starting on the day the contract is formed.
Immediate access and waiver: Because on-demand CPD is digital content supplied online, you will be asked at checkout to confirm that you want access to be made available immediately, and to acknowledge that by doing so you waive your 14-day right to cancel. Where you give this confirmation and access has been made available, you will not be entitled to a refund for change of mind.
If you do not wish to waive this right, please do not give that confirmation. Your access will then be made available only after the 14-day cancellation period has expired, and you may cancel for any reason within that period for a full refund.
This does not affect your statutory rights if the content is faulty or not as described - see the next section.
9. Faulty or Misdescribed Content
Under the Consumer Rights Act 2015, all digital content I supply must be of satisfactory quality, fit for purpose, and as described.
If content will not play, is inaccessible through no fault of your own, or is not as described, please contact me. I will repair or restore access where possible, or refund you where the problem cannot be remedied. Nothing in these Terms affects your statutory rights as a consumer.
10. Acceptable Use of the Learning Site
Your login and access are personal to you. You agree not to:
	•	share your login details or allow anyone else to access content under your account;
	•	record, screen-capture, download (except where downloads are expressly provided), copy, or redistribute any video or other content;
	•	attempt to gain unauthorised access to the learning site, other users' accounts, or any underlying systems;
	•	use the site in any way that is unlawful, or that could damage, disable, or impair its operation.
I may suspend or withdraw your access without refund if you breach these acceptable use provisions or the copyright terms below.
11. Copyright and Permitted Use
All learning content - including videos, slides, handouts, workbooks, frameworks (such as the Strength Beneath framework), illustrations, photography, and the Dragonfly Psychotherapy brand - is the copyright of Dr Victoria Froome trading as Dragonfly Psychotherapy. “Dragonfly Handbooks” and “Strength Beneath” are trade marks belonging to me.
What you may do: When you register for or purchase a session, you are granted a personal, non-transferable right to access the content and to use any accompanying materials for your own learning and, where you are a professional, for your own continuing professional development. You may print accompanying handouts for your own personal reference.
What you may not do: Without my prior written consent, you may not:
	•	copy, reproduce, share, sell, sublicense, lend, broadcast, or distribute the content or accompanying materials, in whole or in part, in any format;
	•	upload content to any website, file-sharing platform, social media, cloud storage, virtual learning environment, or other location accessible to anyone other than you;
	•	show or deliver the content to a group, team, class, or audience, whether paid or unpaid, as part of your own teaching, training, supervision, or CPD provision;
	•	incorporate any substantial portion of the content into your own published work, courses, books, articles, or commercial offerings;
	•	rebrand, repackage, adapt, translate, or present the content as your own work;
	•	remove, obscure, or alter any copyright notice, trade mark, attribution, or other ownership marking.
If you would like to use my materials in a way not permitted above - for example, to deliver training to a team, or to reproduce a passage in a publication - please contact me at victoria@dragonflypsychotherapy.co.uk. I respond to permission requests promptly and will often grant them, with appropriate acknowledgement and any necessary terms. I take infringement of my copyright seriously and reserve the right to take legal action where my materials are reproduced or distributed without permission.
12. Nature of the Content - No Therapeutic or Supervisory Relationship
My CPD and learning content is educational. Accessing it does not create a therapeutic, clinical, counselling, coaching, supervisory, or other professional relationship between you and me, and it does not constitute clinical supervision.
The content is general in nature and cannot account for the particular circumstances of you, your clients, or your patients. It is not a substitute for individual assessment, therapy, medical advice, professional supervision, or your own professional judgement. Where you apply learning in your own practice, you remain responsible for your professional decisions and for working within the limits of your competence and your own professional body's requirements.
Where content touches on your own wellbeing and you are experiencing significant distress, please seek appropriate professional support. The content is not designed for use in a crisis - see the next section.
13. Crisis and Emergency Support
My learning content is not designed for use in a crisis. If you, or someone in your care, are in distress or at risk of harm, please contact:

14. Limitation of Liability
Nothing in these Terms shall limit or exclude my liability for death or personal injury caused by my negligence, for fraud or fraudulent misrepresentation, for breach of any term implied by the Consumer Rights Act 2015 that cannot lawfully be limited, or for any other matter where liability cannot lawfully be limited or excluded.
Subject to the above paragraph, I shall not be liable for any loss of profits, loss of business, loss of anticipated savings, loss of opportunity, loss of or corruption of data, or any indirect, special, or consequential loss arising out of or in connection with your purchase or use of my content.
My total liability to you under or in connection with any contract for learning content shall not exceed the total amount you paid for the content giving rise to the claim. These limitations apply only to the extent permitted by law and do not affect your statutory rights as a consumer.
15. Events Outside My Control
I shall not be liable for any delay or failure to perform my obligations under these Terms where the delay or failure arises from circumstances beyond my reasonable control. This includes (but is not limited to) illness, bereavement, power failures, internet outages, or technical failures affecting my learning platform or payment processor. If such an event occurs, I will let you know as soon as reasonably possible and work with you to restore access or arrange a refund.
16. Data Protection
I am registered with the Information Commissioner's Office (ICO registration ZB904048) and handle your personal data in accordance with the UK GDPR and the Data Protection Act 2018 (as amended by the Data (Use and Access) Act 2025). Full details are set out in my Learning Privacy Notice, available on the learning site.
17. Marketing Communications
I will only send you marketing emails (such as newsletters, updates about new CPD, or information about events) if you have specifically opted in. At registration or checkout, you will be given a clear, separate opportunity to opt in.
If you have purchased from me, I may occasionally send you information about similar content without asking for separate consent, as permitted under the Privacy and Electronic Communications Regulations (PECR). Every such email includes a clear unsubscribe link, and you can opt out at any time.
18. Complaints
I welcome feedback and aim to resolve any concerns quickly and fairly. If you are unhappy with any content or with how your access has been handled, please contact me in the first instance at victoria@dragonflypsychotherapy.co.uk. I will acknowledge your complaint promptly and aim to resolve it within 14 days. If you are not satisfied with my response, you may be entitled to use an alternative dispute resolution scheme; details are available at www.gov.uk/government/publications/alternative-dispute-resolution-for-consumers.
19. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. Both parties irrevocably agree that the courts of England and Wales shall have non-exclusive jurisdiction. As a consumer, you may also be entitled to bring proceedings in the courts of the country in which you live.
20. Changes to These Terms
I may update these Terms from time to time, for example to reflect changes in the law or in how I operate the learning site. The version that applies to your order is the version in force at the time you placed your order. The current version will always be available on the learning site, with the date of last update shown at the top.
21. Entire Agreement
These Terms, together with my Learning Privacy Notice and any content-specific information shown at checkout, form the entire agreement between us in relation to your use of the learning site. If any part of these Terms is found by a court to be unlawful or unenforceable, the remaining parts shall continue in full force and effect.
